In response to mounting concerns regarding the detrimental impact of social media on the mental health of children, New York state officials have initiated a proactive approach.

Governor Kathy Hochul and Attorney General Letitia James, in collaboration with other state leaders, have unveiled two new bills designed to safeguard young users from the potential dangers posed by addictive algorithms and data exploitation prevalent on popular social media platforms.

The SAFE for Kids Act: Addressing Harmful Features 

Leading the charge in this endeavor is the “Stop Addictive Feeds Exploitation (SAFE) for Kids Act.”

This legislation aims to confront the harmful and addictive components inherent in social media platforms such as Facebook, Instagram, TikTok, Twitter, and YouTube. Under this act, individuals under the age of 18 and their parents will be given the choice to opt out of algorithm-driven content feeds. Instead, they can opt for chronological feeds, reminiscent of the early days of social media.

This shift empowers users and parents, allowing them to regain control over their online experiences.

Time Constraints and Accountability 

The SAFE for Kids Act also proposes the implementation of time constraints on platform usage by minors. Users and parents can restrict access to social media platforms between the hours of 12 am and 6 am, as well as set daily time limits on a minor’s usage. This hands over the authority to regulate screen time to caregivers, striking a balance between online and offline activities.

The New York Child Data Protection Act: Safeguarding Privacy 

The second piece of legislation, the “New York Child Data Protection Act,” concentrates on safeguarding the personal data of children and young adults in the online realm. It prohibits online platforms from collecting, utilizing, sharing, or selling personal data of individuals under 18 for advertising purposes without informed consent.

In cases involving users under 13, such consent must be obtained from a parent or guardian. Violations of these privacy safeguards may lead to legal actions and penalties of up to $5,000 per violation.

A Vital Step Towards Safer Online Environments 

New York state officials’ initiative underscores the growing apprehension regarding social media’s impact on the mental well-being of children. While some platforms have introduced voluntary tools to aid parents in managing their children’s online experiences, critics contend that more comprehensive regulation is necessary. These bills, known as the SAFE for Kids Act and the New York Child Data Protection Act, represent a significant stride toward the creation of a more secure online environment for young users.
