In a shocking turn of events, a Texas resident, Harvey Murphy Jr., has initiated a legal battle against Macy’s and EssilorLuxottica, the parent company of Sunglass Hut, for a wrongful arrest that he claims resulted from the erroneous use of facial recognition technology. This lawsuit seeks $10 million in damages, highlighting the potential risks associated with relying on facial recognition software.
Murphy’s nightmare began when he found himself falsely accused of armed robbery, leading to his unjust incarceration for nearly a fortnight. It was only after prosecutors confirmed his alibi that he was finally released. During his traumatic ordeal, Murphy reportedly endured a harrowing experience, being physically and sexually assaulted by three individuals, leaving him with enduring physical and emotional scars.

According to the lawsuit, EssilorLuxottica utilized Macy’s facial recognition tools to identify Murphy in low-quality surveillance footage from a January 2022 robbery at a Sunglass Hut in Houston. During this incident, two armed individuals entered the store, terrorizing the staff and making off with cash and sunglasses. This event not only led to Murphy’s alleged involvement in the 2022 robbery but also linked him to previous thefts affecting both companies.
It remains unclear why EssilorLuxottica sought Macy’s assistance, especially given that the Sunglass Hut in question was situated in a small shopping plaza outside downtown Houston, while the closest Macy’s was a 10-minute drive away.
The partnership between these two retail giants eventually resulted in Murphy’s arrest when EssilorLuxottica presented the facial recognition match to Houston law enforcement. A store employee who had witnessed the robbery identified Murphy from a photo lineup, leading to his arrest while he was at a Department of Motor Vehicles office attempting to renew his driver’s license.
Critically, Murphy’s attorney revealed that he had been in Sacramento, California, at the time of the robbery, not in Houston, as suggested by the facial recognition software. This alibi was subsequently confirmed by his court-appointed attorney and Harris County prosecutors, who promptly dropped the charges against him.
Remarkably, the lawsuit does not name the Houston Police Department as a defendant. Murphy’s legal representative, Daniel Dutko, explained that they believe the police were misled by Sunglass Hut and Macy’s, making these companies the primary culprits in Murphy’s wrongful arrest.
As the lawsuit unfolds, Murphy’s legal team aims to uncover the nature of the relationship between EssilorLuxottica and Macy’s, if any, as well as the criteria Macy’s employs to assess the reliability of a facial recognition match.
